Terms and Conditions for the Provision of AI-Based SaaS Video Generation Service
1. Introductory Provisions
1.1 These Terms and Conditions (hereinafter the “Terms”) govern the rights and obligations between:

Registered in the Commercial Register maintained by the competent court
(hereinafter the “Provider”)
and a natural or legal person (hereinafter the “User”) using the Provider’s SaaS service.
1.2 The Provider operates an online SaaS service enabling the creation of videos from photographs using artificial intelligence technology (hereinafter the “Service”).
1.3 By placing an order or activating a subscription, the User agrees to these Terms.
2. Description of the Service
2.1 The Service allows Users to upload photographs and generate videos using AI technology.
2.2 Video generation operates on a credit-based system.
2.3 Generated videos are stored on the Provider’s servers for a period of 1 year from the date of creation. After this period, the videos may be permanently deleted.
2.4 The Provider is not responsible for backing up videos after the expiration of the above-mentioned period.
3. Subscription and Credits
3.1 The Service is provided on a monthly subscription basis in the following plans:
- USD 49 / month – 40 credits
- USD 99 / month – 100 credits
3.2 Credits are used to generate videos within the Service. The number of credits required for a specific video is determined by the current pricing displayed within the application.
3.3 On each monthly billing date, the User’s credit balance is replenished to the full amount corresponding to the selected subscription plan.
3.4 Unused credits do not roll over to the next billing period and expire without compensation on the renewal date.
3.5 Subscriptions renew automatically unless canceled by the User before the next billing date.
3.6 The User may cancel the subscription at any time through their user account. Cancellation becomes effective at the end of the already paid billing period.
4. Pricing and Payment Terms
4.1 Subscription prices are stated exclusive of Value Added Tax (VAT).
4.2 For Users who are not eligible for reverse charge, VAT at the rate of 21% will be added in accordance with applicable laws.
4.3 For legal entities or VAT-registered persons within the European Union, the reverse charge mechanism may apply if statutory conditions are met.
4.4 Payments are processed through the payment gateway operated by Stripe.
4.5 The Provider does not store payment card details; such information is processed exclusively by the payment gateway provider.
5. User Rights and Obligations
5.1 The User must use the Service in compliance with the laws of the Czech Republic and the European Union.
5.2 The User is responsible for ensuring they hold all necessary rights to the uploaded photographs and materials.
5.3 It is prohibited to upload content that:
- infringes third-party copyright or intellectual property rights,
- contains unlawful, hateful, or otherwise illegal material,
- violates personal rights or privacy.
5.4 The Provider is entitled to remove content violating these Terms and temporarily or permanently suspend the User’s account.
6. Intellectual Property
6.1 The User retains ownership of the photographs they upload.
6.2 The User may use generated videos without territorial restriction, provided their content does not violate applicable laws.
6.3 The User grants the Provider a non-exclusive license to use uploaded content solely for the purpose of providing the Service.
7. Liability and Service Availability
7.1 The Service is provided on an “as is” basis.
7.2 The Provider does not guarantee uninterrupted availability of the Service, particularly due to maintenance, technical interventions, or third-party disruptions.
7.3 The Provider shall not be liable for indirect damages, loss of profit, or data loss unless caused intentionally or by gross negligence.
7.4 The Provider’s total liability is limited to an amount equal to three times the User’s monthly subscription fee.
8. Personal Data Protection
8.1 The Provider processes personal data in accordance with GDPR and applicable data protection laws.
8.2 Detailed information on personal data processing is set out in a separate Privacy Policy document.
9. Withdrawal (Consumers)
9.1 If the User is a consumer, they acknowledge that by requesting the commencement of digital content delivery before the expiration of the 14-day withdrawal period, and providing explicit consent thereto, they lose their right to withdraw from the contract once performance has begun.
10. Final Provisions
10.1 These Terms are governed by the laws of the Czech Republic.
10.2 Any disputes shall be resolved by the competent courts of the Czech Republic.
10.3 The Provider reserves the right to reasonably amend these Terms. Users will be informed of changes via the application or by email.
10.4 These Terms become effective on the date of publication.
